New fatwā from Shaykh ‘Abd al-Razāq al-Mahdī: “What Is the Ruling On Going to Niger or Mali to Fight There?”

يسأل كثير من الشباب:

ما حكم الذهاب إلى النيجر أو مالي للقتال هناك؟

الجواب: حرام ولا يجوز.. وقد أصدرت فتوى مماثلة من قبل تتعلق بليبيا ثم أذربيجان..

أيها الشباب.. إن الجهاد في أرض الشام أعظم الجهاد..ونحن في جهاد دفع وهو فرض عين والعدو على تخوم إدلب المدينة..

وحتى وإن كانت هدنة إلا أن النظام المجرم معروف بالغدر.. فمن ترك الرباط وذهب يقاتل خارج ساحة الشام فهو داخل فيمن تولى من الزحف والنبي صلى الله عليه وسلم يقول:

“اجتنبوا السبع الموبقات.. فذكر منها: والتولي يوم الزحف” متفق عليه عن أبي هريرة.

فلا يجوز ترك ساحة الشام والذهاب إلى أي ساحة أخرى.. ومن يذهب لأجل المال فهو مرتزق وليس مجاهدا..

ففي الصحيحين عن أبي موسى قيل:

يا رسول الله! الرجل يقاتل شجاعة ويقاتل حمية ويقاتل للمغنم.. اي ذلك في سبيل الله؟ فقال: “من قاتل لتكون كلمة الله هي العليا فهو في سبيل الله”.

شبهة: بعض الشباب يقول: هو بحاجة للمال..

الجواب: وكيف يصنع المسكين! إذا وصل إلى هناك ثم بعد أيام أو أسابيع قتل..؟؟

فلا هو فرح بالمال ولا هو نال الشهادة!!

وقد علمتم بما حصل في ليبيا فقد قتل عدد من السوريين ووقع في الأسر آخرون فسلمهم حفتر للنظام ليسومهم أشد العذاب!!

وأشد من ذلك ما ذكره البعض في معرض سؤاله؛ بأن الذهاب إلى النيجر أو مالي إنما هو لقتال المسلمين تحت قيادة فاغنر أو نيابة عن فرنسا..

فإن كان كذلك فهو داخل في باب مظاهرة الكفرة على المؤمنين وقد حكم الفقهاء بأنه ردة!! فالحذر الحذر يا شباب.

أيها الشباب! إن أرض الشام هي أرض الرباط والمعركة مع مليشيا بشار وخامنئي لا زالت قائمة وربما تندلع في أي لحظة.. فأعدوا العدة ورابطوا تؤجروا وأخلصوا نيتكم لله تفلحوا.

توجيه لإخواننا في الحراك الشعبي
يعلم الجميع بأننا نوصي دائما بأنه يجب أن تبقى المظاهرات سلمية ومنضبطة بضوابط شرعية..
والحقيقة هناك بعض التجاوزات من بعض المتظاهرين.

يتواصل معي كوادر وعناصر في الهيئة ويقولون: “نحن مع المطالب المحقة ومع الإصلاحات..
لكن لما يطلق بعض المتظاهرين عبارات عن أميرنا: ديوث… ملعون.. عدو الله..
وعن العناصر والشرطة: شبيحة..
فهذا لا نرضى به..
يا شيخ الكثير من جنود الهيئة يحبونك ويحترمونك ونحن ندافع عنك..
لكن حين يجدونك في مظاهرات فيها مخالفات شرعية.. صاروا ينتقدونك.. ونحن نحاول أن نلتمس لك عذرا ولكن أصبحنا في موقف حرج فوجودك في تلك المظاهرات وسكوتك إقرار.. انتهى.

#الجواب: نحن مع المطالب المشروعة المحقة مهما كانت.. لكن لسنا مع تلك العبارات فهي لا تجوز وغير لائقة..
فقد أخرج أحمد وأبو داود والترمذي وابن حبان عن ابن مسعود؛ قال رسول الله صلى الله عليه وسلم:
“ليس المؤمنُ بالطعَّانِ ولا باللعَّانِ ولا الفاحشِ ولا البذيءِ” حديث حسن وله شواهد.

أيها الشاب.. لكم مطالب محقة مشروعة طالبوا بها ضمن الضوابط الشرعية
ونحن معكم..
ثم إن تلك الألفاظ لها مردود سلبي..
فأنتم يجب أن تكسبوا تأييد وتعاطف الجنود والكوادر بل والقادة ما أمكن لا أن تستفزوهم. وجزى الله خيرا كل من يريد الخير المحرر وأهله.

On July 25, President Qays Sa‘id of Tunisia dismissed Prime Minister Hisham al-Mishishi and suspended the activities of the Assembly of the Representatives of the People by invoking emergency powers under Article 80 of the Tunisian Constitution. The rationale was an out-of-control Covid crisis, continuing economic problems, and political dysfunction within the al-Nahdah-led parliament. Some analysts in the West have called Sa‘id’s maneuver an autogolpe, while many Tunisians locally, according to polling data, have backed Sa‘id’s move. It would not be a crisis, however, if the jihadi talking heads did not weigh in.

It is important to note that jihadi activity in Tunisia has been on a decline in recent years due to counterterrorism and military efforts locally against al-Qaeda (AQ) and the Islamic State (IS), as well as the waning fortunes of foreign fighting endeavors in Iraq, Libya, and Syria as IS lost territory. Nevertheless, it is worth considering the issue given the large-scale mobilization seen in Tunisia over the past decade, and since any form of instability is seen as an opportunity by the jihadi movement. Plus, what initially might appear as rhetoric, as was the case with jihadis speaking on the 2011 Tunisia uprising and having no part in it, could lead to a re-energized mobilization, in the same way that Ansar al-Sharia in Tunisia (AST) was able to take advantage of new conditions following the overthrow of former president Bin ‘Ali.
