New statement from the Islamic Emirate Of Afghanistan: "Why Not The Other NATO Countries Follow Suit?"

NOTE: This message is from the Afghan Ṭālibān and unedited below.

Sha’ban 22, 1431 A.H, Wednesday, August 04, 2010
In the Name of Allah, the Most Beneficent, the Most Merciful.
It is determined that Holland’s forces of nearly 2000 troops will be withdrawn by the earlier this month. This move practically put an end to its invasion of Afghanistan.
The Dutch refused the endeavors and insistence of the US to extend its troops stay till 2012, asserting that it is no longer willing to stay further and continue its soldiers being killed on the ground in Afghanistan. The US’ urge to persuade the Holland to continue its troops’ military presence in Uruzgan province at least for another two months bore no fruit as the Dutch remained inflexible to pull its forces out of Afghanistan as scheduled.
On the other hand, the public of the Netherlands and its diplomats are comfortable and express their joys and solidarity over the decision of troops’ pullout from Afghanistan and consider it a rational motive to avoid the collapse of their own country.
Huffington post, a well-known Dutch press quoted some analysts, as saying that several of the NATO countries intend to take up the Dutch slack and bring their mission in Afghanistan to an end so as to avoid the wasted lives of their soldiers on the ground.
The post reported Gen Van Uhm, commander of the Dutch forces in Uruzgan, as saying in spite of the fact that the Dutch forces had a tough four-year long mission full of risks in such a dangerous place as Uruzgan and he had lost his 23-year old son in clashes with Taliban, yet he is happy to make a timely return for his home country.
With the US bankrupting itself in the war and bringing its empire to the verge of collapse, the Dutch troops’ withdrawal is, undoubtedly, a devastating blow to it which leaves military and financial gab on the ground whose burden may be covered by the US itself.
Furthermore, the withdrawal of the Dutch forces from Afghanistan could possibly provide grounds for Germany to prove its claim to follow suit.
Under circumstances, that is understandable that Germany’s stand to follow suit may create a strong inclination in other partnering countries to accelerate their troops’ withdrawal process as the US’ important allies such as Canada, Australia and Britain view the war in Afghanistan with disappointment, mistrust and the fact remains that the war is a unbearable burden on their shoulders which will get them nowhere.
Every observer would say the US government and military lied to their teeth in order to cover up the failure of their policies and their war crimes in Afghanistan and to irrationally justify Afghan war, while it is a common knowledge that the Afghan nation has a brighter history of good relations worldwide as long as the war is not imposed on them.
In the end, the Islamic Emirate of Afghanistan view the Dutch forces’ pullout as a genuine effort to meet the wants and demands of both Afghan and Dutch nations and a move in better interests of both countries, asking the allied countries which have invaded Afghanistan in collaboration with the US invading forces to take up the Dutch slack and respect the moral, social and religious values of Afghan war-stricken nation and do the job of leaving Afghanistan, the earlier the better, since it is advisable to do something earlier than what has to be done later with dire consequences. Moreover, they are to stop rubber stamping and following the US blindly who is no one else’s friend and well-wisher knowing none but its interests, and to avoid further wasted lives of their soldiers in Afghanistan.
It rational that the US forces should be left in Afghanistan alone to stew in their own juice and suffer the dire and dangerous consequences of their violation and invasion of another country.

Emir of the Caucasus Emirate Dokku Umarov cancels his resignation, calling it fabricated

NOTE: Earlier this week it was reported in the forums that the Emir of the Caucasus Emirate was resigning:

Dokku Abu Uthman Umarov (Hafidhahullah) has formally announced that the mujahid commander Aslanbek Vadalov will be taking over as the new Emir of the Imarat Kavkaz (Islamic Emirate of the Caucasus) due to the health problems that Emir Dokku has apparently been suffering from.
Emir Dokku has asked that the mujahideen in Dagestan, Ingushetia, and Kabardino-Balkaria give bayah to the new Emir.
Emir Dokku has stated that the Jihad must be headed by younger and more energetic emirs, and has emphasized that even after giving up the position of Emir, he will continue on the path of Jihad and will assist the new Emir in whichever ways possible.
May Allah Azza wa Jal protect the new Emir and grant him victory over the kuffar and murtadeen. Ameen!!!!

This seems to have been false as Umarov clarifies this misunderstanding below and unedited.

In the name of Allah the Merciful, the Compassionate!
Praise be to Allah, the Lord of the Worlds. Peace and blessings be upon the Messenger of Allah Muhammad (pbuh), his companions, his family and his followers on the Quran and the Sunnah of the Prophet (pbuh) until the Day of Judgment.
I am, Emir of the Mujahideen of Caucasus Dokku Abu Usman (Dokka Umarov) making this statement on Aug. 2, 2010.
In connection with the current situation in the Caucasus, I think it is not possible to step down from the Emir of the Caucasus Emirate.
Insha’Allah, the previous statement is canceled by my statement. The previous statement was completely fabricated.
I’m officially declaring that the health of me, Alhamdulillah, by the will of Allah, is good to serve on the way of Allah.
Insha’Allah, I will serve in this way as long as Allah gives me life on this earth, and I will kill enemies of Allah.
May Allah help us all!
Allah Akbar!

New statement from 'Abdullah 'Azzām Brigades: "Martyrdom attack on the Japanese M Star oil tanker"

UPDATE 7: The Japanese Transport Ministry came to the conclusion that the Japanese tanker M. Star was hit by explosives, but cannot conclusively state whether it was a terrorist attack and conducted by the ‘Abdullah ‘Azzām Brigades.

UPDATE 6: U.S. Department of Transportation’s Maritime Administration confirmed that the attack on the Japanese tanker M. Star was indeed perpetrated by the ‘Abdullah ‘Azzām Brigades.

UPDATE 5: Anṣār al-Mujāhidīn English Forum translated the ‘Abdullah ‘Azzām Brigades official statement of responsibility for the attack on the Japanese oil tanker M Star last month, which is in Arabic below:
In the name of Allah, the Most Compassionate, the Most Merciful

Allah, the Almighty said: ‎﴾ مَاقَطَعْتُممِّنلِّينَةٍأَوْتَرَكْتُمُوهَاقَائِمَةًعَلَىٰأُصُولِهَافَبِإِذْنِاللَّهِوَلِيُخْزِيَالْفَاسِقِينَ﴿ “Whatever palm-tree you cut down or leave standing upon its roots, It is by Allah’s command, and that He may abase the transgressors” (Al-Hashr: 5) All praises are due to Allah, the supporter of believers, who humiliates the kuffar, who promised us victory and mastery, and accomplished that through jihad on the kuffar. Prayers and peace be upon the Master of messengers, the Imam of the mujahideen, and all of his companions and family. There has been a blessed episode in the series of our jihad for the cause of Allah. It weakened the kuffar’s world order that dominates the lands of the Muslims and steals their wealth. It was to remove oppression from Muslims; it was to recover the plundered right to worship Allah alone and be ruled by His Sharia as well as to recover their right to the wealth that Allah placed in their land that was stolen by the tawagheet of the kuffar’s world order and their lackeys that occupy our lands. A group of your mujahideen brothers in the Sheikh Yusuf al-‘Uyairi; Companies of the Shaheed Abdullah Azzam Brigades executed a successful attack on an economic artery crucial to the kuffar’s world order. The result came as they wished, and, more importantly, as Allah desired. After midnight last Wednesday, the hero and martyr Ayub al-Tyshan— may Allah accept him among the Shuhada’— exploded himself on the Japanese oil tanker (M-Star) in the Strait of Hormuz between the United Arab Emirates and Oman and caused severe damage, as reported by global news agencies. Due to the great impact of this heroic mission on the global economy and price of oil, the enemies of Allah have concealed the truth of the operation. Some of them attributed it to an earthquake. You can believe that because our martyr made them quake by reaching this target, proving to kuffars throughout the world again that the supporters of Allah, the mujahideen, have doors, which were most securely closed, opened before them with the aid of Allah and His strength, despite what they desired from their security systems and intelligence work. This blackout by the enemies of Allah was not unusual, the mujahideen’s attack on such a tanker is a tremendous failure for the kuffar’s world order; it is one of the largest and most advanced tankers and carries no less than two million barrels of oil. The blessed strike was in one of the most important waterways in the world, since the Strait of Hormuz is a main economic artery for the kuffar’s world order, and the Strait’s region is full of the enemy’s naval fleets. How difficult this fortified area would have been to penetrate were it not that Allah had been with the mujahideen. ‎﴾يَاأَيُّهَاالَّذِينَآمَنُواإِنتَنصُرُوااللَّهَيَنصُرْكُمْوَيُثَبِّتْأَقْدَامَكُم﴿ O you who believe! If you help (in the cause of) Allah, He will help you, and make your foothold firm. (Muhammad: 7) If the enemies of Allah had revealed that the earthquake the tanker had endured was actually the earthquake of a martyr; then the prices of oil would have been affected, and the whole world would have known the failure of all the security systems with which the kuffar protect themselves from the strikes of the mujahideen: ‎﴾وَظَنُّواأَنَّهُممَّانِعَتُهُمْحُصُونُهُممِّنَاللَّهِفَأَتَاهُمُاللَّهُمِنْحَيْثُلَمْيَحْتَسِبُواۖوَقَذَفَفِيقُلُوبِهِمُالرُّعْبَ﴿ And they thought that their fortresses would defend them from Allah! But Allah’s (Torment) reached them from a place whereof they expected it not, and He cast terror into their hearts (Al-Hashr: 2) We wish to bring glad tidings to our oppressed Muslim brothers that they have brothers, who will not relent before the head of global kufr is cut off, with Allah’s permission. Let them rejoice that victory is near and join their brothers by striking with an arrow. The gateway to a great reward has been opened for Muslims. We delayed the publishing of this statement until the return of our heroes to their safe havens, thanks to Allah’s grace and favor. This expedition was carried out in the name of the imprisoned Sheikh Umar Abdul Rahman, as a reminder to the Ummah of one, who was one of them – after Allah – who with great virtue, sparked the flame of jihad among the Ummah. And so may it be that he will be released from prison soon, by the will of Allah the exulted One. We say to our Muslim Ummah, and to all the people of the world enslaved by the Taghut of the modern world order, that we will remove oppression from you – Muslims and kuffar – as Allah has commanded us, until Muslims and kuffar are ruled with justice and until everyone has their rights, completely without diminution, as Allah has commanded. And we promise Allah to hold steadfast on this path: ‎﴾حَتَّى لَا تَكُونَ فِتْنَةٌ وَيَكُونَ الدِّينُ كُلُّهُ لِلَّهِ﴿ Until there is no more Fitnah and the religion will all be for Allah alone (al-Anfal: 39) ‎( وَاللَّهُغَالِبٌعَلَىٰأَمْرِهِوَلَٰكِنَّأَكْثَرَالنَّاسِلَايَعْلَمُونَ ) And Allah has full power and control over His Affairs, but most of men know not. (Yusuf: 21) Allah, the Almighty said:‎ ﴾ مَاقَطَعْتُممِّنلِّينَةٍأَوْتَرَكْتُمُوهَاقَائِمَةًعَلَىٰأُصُولِهَافَبِإِذْنِاللَّهِوَلِيُخْزِيَالْفَاسِقِينَ﴿ “Whatever palm-tree you cut down or leave standing upon its roots, It is by Allah’s command, and that He may abase the transgressors” (Al-Hashr: 5)

UPDATE 4: Malcolm Nance at the Small Wars Journal wrote a piece analyzing the attack on the M Star tanker: The Strait of Hormuz:
al-Qaeda’s Newest Jihad Zone?”

UPDATE 3: The International Institute for Counter-Terrorism’s Jihadi Website Monitoring Group released a new report about the ‘Abdullah ‘Azzām Brigades background and involvement in the tanker attack.

UPDATE 2: According to the U.A.E. officials conducting an investigation on incident:

An examination carried out by specialized teams had confirmed that the tanker had been the subject of a terrorist attack.

At the same time, Japanese officials are still investigating the situation and have yet to come to any conclusions. Further, Florian Flade speculates that maybe the ‘Abdullah ‘Azzām Brigades missed their intended target — a Saudi oil tanker.

UPDATE: According to Evan Kohlmann:

The vessel shown in the “Azzam Brigades” communique claiming a bomb attack on a Japanese oil tanker is actually the Saudi-owned Sirius Star.

NOTE: Last week, a Japanese oil tanker, M. Star, was hit by a bomb in the Straits of Hormuz. There was a lot of speculation surrounding who was involved with the attack, though, it was eventually believed it might have hit a submarine or a mine. Then yesterday, the ‘Abdullah ‘Azzām Brigades, based in Southern Lebanon, claimed responsibility for the attack. There proof is a supposed photograph below in the statement showing a fighter pointing toward an oil tanker. As Florian Flade stated: “Seems like [a] photoshop fake. Poss[ibility] the guy is holding the Quran in the real image.” For more on his thoughts see his recent blog post about the incident. Further, in the past, the ‘Abdullah ‘Azzām Brigades have been notorious for claiming attacks that were perpetrated by other groups. In addition, a Mitsui O.S.K. employee, the company that owns the ship, stated on anonymity: “So far, there has been nothing special [uncovered].” As such, ‘Abdullah ‘Azzām Brigades seems they published this statement more for publicity than anything else since the group primarily is internet-based except for its occasional claims of responsibility for rocket attacks against Israel.

Translation of 'Aṭīyyah 'Abd al-Raḥman's essay "Leaving for Battle and the Precondition of Takfīr"

NOTE: ‘Aṭīyyah ‘Abd al-Raḥman is a senior leader in al-Qā’idah who according to the United States State Department is based in Iran. He is also purported to be the writer of a letter to Abū Muṣ’ab al-Zarqāwī on December 11, 2005, which warned al-Zarqawi:

He risked removal as al-Qaeda’s leader in Iraq if he continued to alienate Sunni tribal and religious leaders and rival insurgent groups.

Abū Muṣ'ab al-Sūrī's book "Muslims in Central Asia and The Coming Battle of Islam?" was translated into English

NOTE: Muṣṭafā Setmariam Naṣar (Abū Muṣ’ab al-Sūrī) is considered “the most articulate exponent of the modern jihād and its most sophisticated strategies.” He is most famous for his 1600-page book The Global Islamic Resistance Call (Da’wat al-Muqāwamah al-Islāmīyyah al-‘Alāmīyyah) which appeared on the Internet in late 2004. He was captured in the Pakistani city of Quetta in late October 2005 and it has been speculated that he was one of the prisoners held at the US ghost prisons. It is believed he was renditioned and currently in a Syrian prison. “Muslims in Central Asia and The Coming Battle of Islam?” is about the history of Central Asia, its Muslims and analysis on the Muslim nature of these countries. al-Sūrī tackles many issues, such as nuclear weapons that are stored in Central Asian countries and the indigenous Muslim jihadist movements.

Audio message from al-Qā’idah in the Islamic Maghrib’s Abū Muṣ’ab ‘Abd al-Wadūd (‘Abd al-Malik Drūkdīl): “On the Failed France Operation”

New statement from the Islamic Emirate Of Afghanistan: "Gen Petraeus’ New War Strategy “Mass Murder”"

NOTE: This message is from the Afghan Ṭālibān and unedited below.

Sha’ban 16, 1431 A.H, Thursday, July 29, 2010
In the Name of Allah, the Most Beneficent, the Most Merciful.
There are speculations that the ousted Gen Mc Chrystal’s successor, Gen Perraeus, who has been chosen by the mutual consent of the White house and Pentagon, would hit the mark in six month’s time, that is, break the Mujahideen resistance across the country and enable the Kabul puppet administration to stand up for itself accelerating part of the troops’ withdrawal process from the country in a way that it may not affect the remaining troops on the ground in Afghanistan.
Gen Petraeus, in his first statement after a month his arrival in Afghanistan, pointed out to his commanders on the ground that his presence in Afghanistan was to ensure the final showdown and decisive operation, but for that, they were left no chances in Afghanistan to achieve their goal.
The sequence of the events, if observed, David Petraeus, after two months of his taking charge of the command in Afghanistan, does not seem to have come up with unique military tactics and extraordinary warfare so as to succeed in restoring the losing morale of the US soldiers in Afghanistan.
Furthermore, the attacks of every type on US invading forces in the country, gunfights, ambushes, IEDs, sniper fires, rocket propelled grenades and other weapons have reached the record levels since Gen Petraeus took the charge of battle in Afghanistan.
According to the Pentagon data, the deaths bring the US soldiers killed in Afghanistan to 150 in June, taking death toll of the US forces to 170 since the beginning of July. As things stand, Gen Petraeus’ appointment to the post did not only spiral down the progress of the invading forces in the country but also had the US and its allies military bases, barracks, outposts, airbases and military and logistical convoys attacked by Mujahideen several times more than ever.
As a matter of fact, the only accomplishment Gen Petraeus has made so far is civilian casualties (mass murder), which has to be considered his new war strategy and tactics.
Regrettably, some 90 non-combatant defenseless civilians have been martyred in the US invaders’ blind bombardments in Helmand’s Kajak, Paktis’s Zurmat districts and in other parts of the country over the past two weeks.
It appears that Gen Petsaeus will continue working out such war strategies and tactics (civilian casualties or mass murder) in the coming time as the way things are, the US invading forces are no match for Mujahideen in every war front and battle zone throughout the country; furthermore, the US forces have lost morale on the ground which leaves the Gen Petraeus no any alternatives but to resort to carrying out his vicious and wicked war pans and tactics which are only causing further civilian casualties (mass murder) over and over again.
Gen Petraeus has to realize the fact that the civilian casualties will make things worse for the US invading forces and their allies in Afghanistan, and create growing resentment among Afghan masses for the invading forces, turning the ordinary people against the US invaders which will definitely work out in favor of Mujahideen.
The capture and handover of the US soldiers in Logar’s Charkh district on July 24 by ordinary people is a case in point. This shows a clear evidence of the Afghan masses’ strong hatred towards US invaders.
Gen Petraeus is reminded if the civilian casualties continue to increase in such an alarming rate, it is not unlikely that the masses would give a full vent on the likes of Gen Petraes, balancing the accounts, therefore, it is advisable to manly admit the defeat as Mc Chrystal put it bluntly by admitting that Afghan war is unlikely to win over. To put it another way, further stay for the US and their allies in Afghanistan is the same as digging ones own grave.
There is a worldwide growing concern over the long-delayed Afghan war, the American nation and whole world read the Afghan war as a burden and defeatist signal, which is ,with each day passing, deteriorating rather than progressing, whereas the number of the anti Afghan war people is increasing in the West. Fearing the downfall, some of the Western countries have set deadlines for their troops’ removal from Afghanistan.
It is high time Gen Petraeus knew full well the ground reality that he has the command of the forces in Afghanistan whose morale has already been down and they have been mentally defeated seeing no power in them to stand the war against the Afghan Mujahideen. Under the circumstances, Gen Peraeus would reap the reward of his job in Afghanistan in the form of disgrace, blame and defeat. Insha Allah.

A Lesson on Islamic Law for Newt Gingrich

Earlier today, Newt Gingrich, Senior Fellow at the American Enterprise Institute and former Speaker of the United States House of Representatives, presented a speech titled: “America at Risk: Camus, National Security, and Afghanistan.” In it he discussed a variety of issues, but the one that stuck out for me dealt with the sharī’ah (Islamic law). Gingrich stated:

harī’ah in its natural form has principles and punishments totally abhorrent to the Western world, and the underlying basic belief is that law comes directly from God. It is therefore imposed upon humans, and no human can change the law without it being an act of apostasy [irtidād].

Any student of Islamic studies will realize this is a completely simplistic understanding of the sharī’ah. Before discussing the sharī’ah and the establishment of law in Islam it is crucial to understand a few things first.
Indeed, in Islam, God is considered the lone sovereign (ḥākimīyyah). For instance, in Qur’anic verse 2:107 it says: “Do you not know that to God belongs the sovereignty of the heavens and the Earth”? But there are some Muslim jihādīs, such as Sayyid Qutb that link God’s sovereignty to governance. According to Sayed Khatab, Qutb’s theory of ḥākimīyyah denotes the following ideas: (1) “the system of government in Islam is not similar to any other system”; (2) “it is distinct from all forms of government in secular democracies”; (3) “it is constitutional”; (4) “it is not inherently theocratic or autocratic”; and (5) “the form of Islamic government has no impact on the Islamic identity of the state.”
In addition, the concept of ḥākimīyyah is connected to the concept of tawīd (oneness of God). As Qutb states:

Tawīd is that Allah is the Lord and Sovereign of people not merely in their beliefs, concepts, consciences, and rituals of worship, but in their political affairs … There is no God but God. There is no one worthy of worship except God, there is no creator or sustainer except God … There is no one in charge of the universe or even one’s own affairs except God … Thus, Muslims worship him alone … Muslims believe that there is no true ruler above them except Allah, no legislator for them except God, no one except God to inform them concerning their relationships and connections with the universe, with other living creatures, and with their fellow human beings. This is why Muslims turn to God for guidance and legislation in every aspect of life, whether it be political governance, economic justice, personal behavior, or the norms and standards of social intercourse.

When discussing the idea of Islamic governance, it was also essential for Qutb to connect the above terminologies – ḥākimīyyah and tawīd – to the sharī’ah. Qutb contends that for one to institute the sharī’ah one needs to first accept the idea behind tawīd, which based on the above definition, lends credence to the notion of ḥākimīyyah and one’s willingness to submit to the will of God and its laws. In other words, before one can follow the sharī’ah, one needs to believe in the idea of tawīd and ḥākimīyyah, which is a quintessential part of joining the faith of Islam.
The major problem with this is that Qutb and other jihadists for that matter are conceptualizing an Islamic state under the institutional framework of a nation-state, in that laws are codified and for jihādīs it is a totalitarian system that does not have any checks on power or law. This differs from the classical understanding, which Noah Feldman brilliantly explains in his book The Fall and Rise of the Islamic State. In it, Feldman points out that in the classical Islamic state, the ‘ulamā (religious scholars) provided a check on the power of the ruler since law was not a monopoly of the state like it is in the framework of the nation-state. This legal system was ever evolving and changing since there was a separation between the state and the sharī’ah. Therefore, according to Feldman it created: “[a] crucially [important] balance between the authority of the ruler and the law itself.”
This returns us to the original point of this post, which dealt with the creation of the sharī’ah. One derives sharī’ah from two primary sources: the Qur’ān and the Sunnah (actions and sayings of Muhammad). Islamic jurisprudence (fiqh) allows the ulamā’ to interpret aspects of the sharī’ah to issues not directly addressed by the Qur’ān or Sunnah. These tools include using ijmā (consensus of the scholars) and after that qīyās (analogy), while Shī’ah use ‘aql (reason) instead of qīyās.
The only individuals who are allowed to practice fiqh are qualified mujtahid’s (one who performs ijtihād or independent thought) who have gone through extensive training in classical Islamic and Qur’ānic sciences. One might answer by stating, well, I think I heard or have read something about the “gates of ijtihad being closed”. This is also a misnomer. Hakim Murad explains: “sophisticated mechanisms were available which not only permitted qualified individuals to derive the Sharī’ah from the Qur’ān and Sunnah on their own authority, but actually obliged them to do this.” Further, there are different levels of ijtihād that a mujtahid could perform. The highest level is mujtahid fī-l-shar, which is an individual who does not need to follow a particular madhhab (legal school, there are four in Sunnī Islam) because he is advanced in his knowledge of the Islamic sciences. These were the individuals whom Abū ‘Abdullah Muhammad Ibn Idrīs al-Shafi’ī (or al-Shafi’ī) explained the “gates of ijtihād” were closed for since a mujtahid of those heights could no longer exist. Therefore, the “gates of ijtihād” being closed was in reference to not being able to establish another madhhab outside of the established four. As such, the ‘ulamā’ were still allowed to perform ijtihād, just the lower levels. These included: (1) a mujtahid fī-l-madhhab who could perform ijtihād within a specific school on an array of legal issues; (2) a mujtahid muttabi (follower) “who follows his madhhab while being aware of the Qur’ānic and adīth (sayings of Muhammad) texts and the reasoning, underlying its positions”; and (3) a mujtahid muqallid (emulator) “who simply conforms to the madhhab because of his confidence in its scholars, and without necessarily knowing the detailed reasoning behind all its thousands of rulings.”
These processes still exist at traditional religious establishments such as Jāmi’at (university) al-Azhar in Egypt, Jāmi’at al-Qarawiyyin in Morocco, Jāmi’at al-Zaytuna in Tunisia, and others. For example, scholars at al-Azhar issued a fatwā that discusses the permissibility of celebrating Mothers Day, a non-Islamic holiday (for the record it is indeed permissible). One can see that the process of the sharī’ah is far more complicated and intellectually rigorous than how Gingrich described it in his speech and that Islamic scholars have the tools to evolve the law as time changes. This does not excuse the heinous acts in the name of trying to establish the sharī’ah by jihadists, but most of them are not qualified to truly derive Islamic law, but that is a whole other issue.
